- POLICY STATEMENT
- This policy provides staff and members of the public with a working knowledge of how cases are selected by the Division of Child Support Services (DCSS) for administrative asset seizure. The Federal government requires states to enter into agreements with financial institutions doing business within their state to conduct a quarterly data match. The data match identifies financial assets belonging to parents who are delinquent in their child support obligations. The DCSS may issue liens or levies on the SP’s assets when a match is identified.
- This data match process is automated through AZCARES and is known as Financial Institution Data Match (FIDM). The process for larger financial institutions that operate in two or more states is known as Multi State Financial Institution Data Match (MSFIDM). The automated AZCARES process is the same for FIDM or MSFIDM.
- The DCSS levies the assets of the Support Payor (SP) when the case meets the criteria, and a financial match is identified. The DCSS only levies in-state assets. For out of state assets, the DCSS must initiate FIDM or MSFIDM limited service requests to the IV-D agency in the state where the account is located.
- APPLICABILITY
- This policy applies to all Arizona IV-D program staff performing Title IV-D services.

DEFINITIONS
A “Consistent Payor” is defined as a Support Payor that has paid his/her current child support obligation and court-ordered arrears as required by Income Withholding Order and/or direct payments for the previous consecutive nine (9) months when the case is:

Accruing current child support;

An arrears-only case, and the arrears have not been adjudicated, or
-
A Past Support Judgment-only case.

Participants use a plastic EBT debit card, called a QUEST Card, at Automated Teller Machines (ATMs) Point-of-Sale (POS) devices and authorized online vendors. Participants may access their benefits from assigned Electronic Benefit Transfer (EBT) accounts. The EBT Processing System functions through an interface with the Arizona Technical Eligibility Computer System (AZTECS).

OCSS-operated program that matches noncustodial parents who owe past-due child support with accounts held in financial institutions doing business in more than one state. Child support agencies receive the data matches and seize/levy accounts, when appropriate.

A federal supplemental income program funded by general tax revenues (not Social Security taxes). It helps aged, blind, and disabled people who have limited income and resources by providing monthly cash payments to meet basic needs for food, clothing, and shelter.

- CRITERIA
- The case is an open IV-D case.
- There is a valid child support order in effect.
- There must be more than $250.00 in the SP’s account.
- The SP’s account is not a welfare benefit or Electronic Benefits Transfer (EBT) account.
- Nonpayment occurred within the last 30 days and, for checking accounts only, the SP is not a consistent payor.
- The SP does not have a financial hardship and is not receiving Social Security Income (SSI) or Social Security Disability Insurance (SSDI).
