Division Responsibility to Locate Parties

- OVERVIEW
- The purpose of this policy is to provide staff and members of the public a working knowledge of the Division of Child Support Services’ (DCSS) responsibility to obtain location information for noncustodial parents (NCPs) and/or custodial parents (CPs), as well as sources of income and/or assets.
- APPLICABILITY
- This policy applies to all Arizona IV-D program staff performing title IV-D services.
- POLICY
- The DCSS shall demonstrate diligent efforts to obtain information to locate parties and/or parties' assets in a Title IV-D child support case, as appropriate.
- CRITERIA
- When it is necessary to locate an absent party in a child support case, the DCSS shall make locate attempts in order to:
- Establish paternity
- Establish a child support order
- Enforce a child support order
- Modify a support order
- Cooperate with intergovernmental IV-D limited requests for location services
- The DCSS shall obtain information to locate a party when they are:
- Ordered to pay a child support obligation
- The recipient of a child support obligation
Any Arizona Title IV-D program staff that knowingly requests or obtains information for purposes other than to locate parties in subsections A and B is guilty of a class 1 misdemeanor.
- PROCEDURE
- This policy is supported by staff procedures, which identify how action related to this policy will be conducted, including responsibilities, time frames, and required actions.
