06. Receipt of Administrative Subpoena

  1. The worker will receive an affidavit of service (for service by process server) or registered mail receipt indicating that the administrative subpoena has been served. 
  2. For administrative subpoenas sent through first class mail, it is practice to assume that the subpoena has been served five (5) days from date of mailing.

Note: The subpoena is not considered mailed until the day after the date on the subpoena.

  1. Once the worker is notified that the subpoena has been served, or assumes under an agreement, that it has been served, the worker will:
  2. Go to the Administrative Subpoena Request (ADSR) screen.
  3. Type a “B” in the Action field and press <Enter>.  This will bring up the Administrative Subpoena List (ADSL) screen.
  4. Place the cursor under the applicable request and press <Enter>.
  5. Type an “M” in the Action field.
  6. Type in the date the subpoena was received in the Date Received field.
  7. Press <Enter>.
  8. This will generate worklist item E0060, Review Status of Admin Subpoena after 15 days.
  9. Narrate on the Case Activity List (CAAL) screen that a subpoena has been served using E3702, Admin. Subpoena Served.

Note: Subpoenas sent by first class mail provide no means of verification of receipt

  1. The E0060, Review Status of Admin Subpoena worklist item will stop running once this field is populated.
  2. In the event the subpoenaed entity requests additional time to comply with the subpoena, the worker will narrate such request on the Case Activity List (CAAL) screen using Activity Code E3709 Admin Subpoena - Info Delayed.  This will not cause the E0060, Review Status of Admin Subpoena worklist item to stop running.
